Civil Status Extracts
Conditions and general framework for obtaining copies or extracts of civil status records.
Introduction
Since issuing a certified copy of a record or allowing direct access to the register by third parties may cause moral harm to the record holder or to entitled persons, the legislator has established specific conditions for obtaining civil status documents.
Obtaining Civil Status Documents
Copies or extracts of civil status records may be issued depending on the legal status of the applicant.
Persons Authorized to Obtain the Documents
- The record holder.
- His or her direct ascendants or descendants.
- The spouse, provided there is no divorce or legal separation.
- The legal guardian.
- The legal representative in cases of minority or incapacity.
- The Public Prosecutor.
Any other person wishing to obtain a certified copy or an extract of a civil status record (birth, marriage, or death) must first obtain authorization from a judge.
