- Decision of the Minister of Equipment and Housing dated 19 October 1995 setting the documents required for a subdivision file, including the specifications, and the approval procedures and forms.
- Decision of the Minister of Equipment and Housing dated 19 October 1995 defining the composition of technical subdivision committees and how they operate.
✅ Eligibility conditions
- The applicant must be the owner (or a legally authorized representative) of the property to be subdivided.
- The property’s designation must not conflict with the zoning and land-use allocation in the area’s urban plan.
- A complete file must be submitted in accordance with applicable legislation.
📋 Required documents
- Application on a specific form provided by the administration, signed by the owner(s) or their representatives.
- Presentation note for the subdivision operation describing in particular: planning rules in the urban plan, technical features of the land, the urban approach and its consistency with the surroundings, and the planned program (housing types and public facilities).
- Proof of ownership (land title, deed, court ruling, etc.).
- Location plan of the land to be subdivided.
- Land registry extract if registered; if not registered, a plan at scale at least 1/1000 linked to geographic coordinates, prepared by a surveyor.
- Topographic plan showing elevations of the land and adjoining plots (at least 1/1000), prepared by a surveyor, indicating existing buildings/plantations/public utilities and the portion not intended for subdivision, if applicable.
- Subdivision plan (at least 1/1000) showing plot numbering, areas, land use, car-parking areas, roads and connections, networks, and reserve poles where applicable.
- Overall plan showing the project’s general composition and a brief 3D diagram; where applicable, models or other visualization means for subdivisions of 5 hectares or more.
- Subdivision specifications (rights and obligations of the subdivider and buyers/lessees) and the development/sanitation program, including urban rules enforceable against third parties, aligned with the model specifications.
- Estimated schedule for execution and completion of works.
- Certificates from competent services confirming the feasibility of sanitation and/or supply of drinking water, electricity, or telecom connection.
- Conditions and methods for phased execution of works, if applicable.
- Note or study on the project’s impacts on the surrounding environment, according to applicable rules.
- Alignment decision if the property borders the public road domain or the maritime public domain.
Note: Documents “1”, “3”, and “5” are submitted in three copies; the remaining documents are submitted in seven copies.
⏳ Processing time
- The administrative decision is issued within a maximum of 4 months from the date the complete file is submitted.
- The applicant is notified of the decision within 1 month from the date it is issued.
